Terms & Conditions

The following terms and conditions apply to all tree surgery, arboricultural, and related services provided by A and J Home Improvements (Midlands) Limited, trading as A and J Tree Services (“the Company”, “we”, “us”, “our”). By instructing us to carry out work, you (“the Customer”, “you”, “your”) agree to be bound by these terms.

1. Company Information

A and J Tree Services is a trading name of A and J Home Improvements (Midlands) Limited, a company registered in England and Wales. Our registered office is in Willenhall, West Midlands. 2. Call-Out Charge and Site Assessment

We charge a call-out fee of £70 (inclusive of VAT where applicable) for all initial site visits and assessments. This fee is payable at the time of booking the site visit and secures your appointment. If you proceed with the quoted work, the £70 call-out charge will be deducted in full from your final invoice. If you choose not to proceed with the work, the call-out charge is non-refundable. The site assessment includes a visual inspection of the tree or trees in question, a discussion of your requirements, and a written quotation for the recommended work.

3. Quotations

All quotations are provided in writing following our site assessment. Quotations are valid for a period of 30 days from the date of issue unless otherwise stated. Prices quoted are based on the condition of the tree or trees and the site conditions as observed at the time of the assessment. If conditions change materially between the date of the quotation and the date of the work — for example, due to storm damage, disease progression, or changes to site access — we reserve the right to revise the quotation accordingly. Any revised quotation will be discussed and agreed with you before work commences.

4. Acceptance and Booking

Work is booked upon your written or verbal acceptance of our quotation and payment of the £70 call-out charge (if not already paid at the assessment stage). We will confirm your booking and provide an estimated date or date range for the work. While we make every effort to carry out work on the agreed date, tree surgery is weather-dependent and we may need to reschedule if conditions are unsafe. We will notify you as soon as possible if rescheduling is necessary and will arrange an alternative date at the earliest opportunity.

5. Payment Terms

Payment for all work is due in full upon completion, less the £70 call-out charge already paid as a deposit. We accept payment by bank transfer, cash, or cheque. For larger projects (typically those exceeding £2,000), we may agree staged payments at the time of booking. Payment terms will be set out clearly in the quotation. Any invoices not settled within 14 days of the completion date may be subject to late payment charges in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

6. Cancellation Policy

If you cancel a confirmed booking, the following terms apply. If you cancel before we have attended site for the assessment, the full call-out charge of £70 will be refunded. If you cancel after the site assessment but before work has commenced, the £70 call-out charge is retained as a cancellation fee and is non-refundable. This is because the call-out charge covers the cost of the site visit, assessment, and quotation preparation, which has already been carried out. If you cancel after work has commenced, you will be liable for payment for all work completed up to the point of cancellation, plus any costs incurred in making the site safe.

7. Scope of Work

The work carried out will be as described in the agreed quotation. Any additional work identified during the course of the job — for example, additional trees requiring attention, hidden decay revealed during pruning, or unforeseen access difficulties — will be discussed with you before being carried out, and any additional costs will be agreed in advance. We will not carry out work beyond the agreed scope without your prior consent.

8. Access and Site Conditions

The Customer is responsible for providing adequate access to the work site. If access difficulties are encountered that were not apparent at the time of the site assessment — for example, locked gates, restricted access through the property, or third-party land that requires permission to cross — and these difficulties result in additional time or equipment being required, we reserve the right to adjust the price accordingly, subject to your agreement. The Customer is responsible for informing us of any underground services (gas, water, electric, drainage) in the work area, and for identifying the boundaries of their property where boundary trees are involved.

9. Tree Preservation Orders and Planning Consent

It is the Customer’s responsibility to inform us if any tree on their property is subject to a Tree Preservation Order (TPO) or if their property is within a conservation area. We will check with the relevant local authority as part of our standard process, but we cannot accept liability for work carried out on a protected tree where the Customer has failed to disclose the protection. Where consent is required, we will submit applications on your behalf and no work will commence until consent has been granted.

10. Waste Removal

Unless otherwise stated in the quotation, all prices include the removal of all arisings (branches, timber, and foliage) generated by the work. Timber and logs will be offered to the Customer first; any material not wanted by the Customer will be removed from site and disposed of or recycled responsibly. Stump grindings are typically left on site and can be used as mulch; removal of grindings can be arranged at additional cost if required.

11. Insurance and Liability

A and J Tree Services holds comprehensive public liability insurance and employer’s liability insurance. Copies of our insurance certificates are available on request. We accept liability for any damage to property caused directly by our negligence during the course of the work. We do not accept liability for damage to underground services that were not disclosed to us prior to the commencement of work, for pre-existing damage or defects, or for damage caused by circumstances beyond our reasonable control (including but not limited to extreme weather during or after the work).

12. Guarantees

All work is carried out to British Standard BS3998 (Tree Work — Recommendations) by NPTC qualified arborists. We guarantee the quality of our workmanship. However, we cannot guarantee the future health or survival of any tree, as trees are living organisms whose health is affected by many factors beyond our control, including weather, soil conditions, disease, and the actions of third parties. Where stump grinding has been carried out, we cannot guarantee that regrowth will not occur from remaining root material, though this is uncommon with thorough grinding.

13. Third-Party Property

Where work involves trees that overhang or are adjacent to neighbouring properties, roads, or public land, we will take all reasonable precautions to prevent damage or inconvenience to third parties. Where necessary, we will notify neighbours and arrange temporary access. The Customer is responsible for obtaining any necessary permissions from neighbouring landowners where access through third-party land is required to carry out the work.

14. Health and Safety

All work is carried out in compliance with the Health and Safety at Work Act 1974 and all relevant regulations. Our team will establish appropriate safety zones around the work area and may need to restrict access temporarily during certain operations (such as felling or use of aerial equipment). We ask that the Customer, their family, and any pets remain clear of the work area while operations are in progress.

15. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to severe weather, flooding, pandemic restrictions, road closures, equipment failure, or government action.

17. Governing Law

These terms and conditions are governed by the laws of England and Wales. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Changes to These Terms

We reserve the right to update these terms and conditions from time to time. The version in force at the time of your booking will apply to your contract with us. The current version is always available on our website at aandjtreeservices.co.uk.
